Foreign ETFs and U.S. Tax

A non-U.S.-domiciled ETF can be a PFIC even when it tracks a familiar U.S. market index.

Why this matters on a U.S. return

Fund domicile matters more than the benchmark name.

Broker reports may not calculate U.S. PFIC tax.

Accumulating funds can create U.S. issues not obvious from cash distributions.

Investment reporting abroad often becomes complicated because U.S. rules classify the asset itself, not simply the account name used by the local bank or broker.

How to approach the filing

  1. Check legal domicile.
  2. Review PFIC classification.
  3. Keep lot-level basis.
  4. Track annual statements.

Build the filing from the portfolio outward. Record balances, income and transactions, then identify any holdings that need special treatment such as PFIC reporting.

Where expats get caught out

  • Using ticker symbol alone to determine treatment.
  • Assuming an S&P 500 tracker is automatically U.S.-tax friendly.
  • Ignoring accumulating-fund income.

Terms such as ISA, TFSA, pension, fund or savings plan describe the local product. They do not guarantee the same tax treatment in the United States.

What to have in your records

Save statements at both the account and security level. Account balances support foreign-account reporting, while lot-level records support gain, dividend and PFIC calculations.

Archive closed-account statements too. FBAR and Form 8938 questions can arise after an account is gone, and later sales may still depend on historical basis.

When to bring in an expat tax professional
